Nothing is more important to a parent than the wellbeing of their children. In the unfortunate event a child is hurt, the injuries can be life-altering for both the child and the parents.
The rules for bringing a lawsuit on behalf of a minor is different than those for adults. A minor cannot legally bring an action on their own behalf in the State of New Jersey. That means that the child can either 1. toll the statute of limitations for personal injury cases until they turn 18 years of age, where they will then have 2 years from their 18th birthday to file the lawsuit, or 2. have their parents bring the lawsuit on their behalf as their legal guardian. Often, a child may be too young to fully explain how the accident or injuries occurred.
